Abstract

Industrial property legislation falls under the broader domain of intellectual property (IP) law, which protects the creations of the human mind. IP is generally divided into two branches: industrial property and copyright. This article provides a short analysis of Afghanistan’s industrial property legal framework’s compliance with international obligations and standards under the World Intellectual Property Organization (WIPO) treaties and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) of the World Trade Organization (WTO). Focusing on key legislation governing patents, trademarks, industrial designs, geographical indications, trade secrets, and competition, the study examines the extent to which domestic laws align with global standards, identifying both achievements and gaps in enforcement and institutional capacity. Using a doctrinal and comparative methodology, it analyzes primary sources such as Afghan legislation and international treaties, supplemented by scholarly publications and WIPO/WTO reports. The study is significant as it assesses how Afghanistan’s industrial property framework supports innovation, fair competition, and economic development, and offers recommendations for legislative reform, institutional strengthening, and effective enforcement. The findings indicate that while foundational laws substantially comply with international norms, continued reform and capacity-building are essential for full compliance and integration into the global industrial property system.
